Terms of Service

1. Acceptance of terms

You must be at least 13 years old (or the age of digital consent in your region) and able to form a binding contract. If you use Make This Clear on behalf of an organization, you confirm that you have authority to bind that organization.

2. Service description

Make This Clear provides writing, editing, rewriting, plagiarism detection, AI image prompts, and research utilities powered by LLMs. Features run through our Cloudflare Worker proxy, authenticate via Supabase, and store user-approved data inside Supabase Postgres. We may add or remove features, beta-test new workflows, or change limits at any time.

3. Account & security

• Maintain accurate registration data and keep your Supabase-issued credentials confidential.
• Immediately notify us through our support page of suspected compromise.
• You are responsible for actions taken from your account, including use by collaborators or automated scripts.
• We reserve the right to disable accounts involved in credential stuffing, scraping, fraud, or platform abuse.

4. Acceptable use

You agree not to:

• Upload or generate content that is illegal, malicious, or violates the rights of others.
• Attempt to reverse engineer, probe, or bypass rate limits, security controls, or private APIs.
• Automate requests in a way that overloads the service or mines credits outside of documented flows.
• Use our outputs to develop competing models by scraping prompts/results at scale.
• Misrepresent generated content as human-authored when disclosure is legally required.
• Interfere with other users, including DDoS attacks, credential stuffing, or credential sharing.

5. Credits, subscriptions, and billing

• Subscriptions renew automatically each billing cycle through Stripe until you cancel from Settings or via Stripe's customer portal.
• Pay-as-you-go credit packs load instantly, do not expire, and are non-refundable except where required by law.
• You authorize Stripe to store your payment instrument and charge applicable taxes.
• Failed payments may result in immediate suspension until the invoice is settled; we may throttle usage to prevent unpaid consumption.
• We may adjust pricing or credit tables with prior notice posted in-app or via email.
• Chargebacks triggered by fraud review may void remaining credits and lead to account closure.

6. AI content disclaimer

• LLM outputs can be incorrect, biased, or unsafe; always review before publishing or relying on them.
• You are solely responsible for complying with laws, industry rules, and disclosure obligations when using generated text.
• We are not liable for damages arising from reliance on AI-generated results, even if a Make This Clear interface suggested the content.
• Do not use the service for regulated medical, legal, or financial advice without a qualified professional review.

7. Intellectual property

• You own the content you input and the outputs you decide to keep. We only access it to provide the service, comply with law, or enforce these Terms.
• You grant us a limited license to process, store, and securely transmit that content to integrated LLM providers.
• All Make This Clear software, branding, UI design, and documentation remain our exclusive property.
• We do not use your prompts or documents to train proprietary models unless you give us written permission.

8. Privacy

Our collection and use of personal information is described in the Privacy Policy. By using the service you consent to those practices, including transfer to Supabase, Cloudflare, and LLM vendors needed to fulfill requests.

9. Termination

• You may cancel anytime from Settings or by emailing support. Subscriptions stay active until the end of the paid term.
• We may suspend or terminate access immediately for violations, suspected fraud, or prolonged inactivity.
• Upon termination we delete or anonymize stored documents per our retention schedule, but we may keep billing and audit logs.

10. Disclaimers

The service is provided “as is” without warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted uptime, error-free AI responses, or compatibility with every workflow.

11. Limitation of liability

To the fullest extent allowed by law, Make This Clear and its team are not liable for indirect, incidental, special, consequential, or exemplary damages, nor for lost profits or reputation. Our total liability for any claim is limited to the amount you paid for the service in the 3 months preceding the incident.

12. Indemnification

You agree to indemnify and hold harmless Make This Clear, its affiliates, and team members from claims arising from your content, your breach of these Terms, or your violation of applicable law.

13. Governing law & venue

These Terms are governed by the laws of the State of California, excluding conflict-of-law principles. All disputes will be heard in the state or federal courts located in San Francisco County, California, and you consent to their jurisdiction.

14. Changes to these Terms

We may update these Terms to reflect new functionality, pricing, or legal requirements. If changes are material, we will notify you via email or in-app notice at least 7 days before they take effect. Continued use after the effective date means you accept the updated Terms.
